Terms of Service

These Terms of Service ("Terms") govern your access to and use of EquestrianOS, operated by Trail Barns ("we", "us", "our"), available at lessons.trailbarns.com.

By creating an account, logging in, or otherwise using the platform, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them. If you are using the platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not use EquestrianOS.

EquestrianOS is a riding school management platform that provides tools for:

• Managing student enrolment, progression levels, and skill evaluations
• Scheduling lessons and tracking instructor availability
• Communicating student progress to parents and guardians via a parent portal
• Managing subscription tiers and lesson allowances
• Syncing lessons with Google Calendar (optional, requires explicit authorisation)
• Generating analytics and insights about student cohort performance

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

Access to EquestrianOS requires authentication via Manus OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to notify us immediately at [email protected] if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform.

You agree to use EquestrianOS only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform to store, transmit, or distribute unlawful, defamatory, or abusive content
• Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure
• Reverse engineer, decompile, or disassemble any part of the platform
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the platform without our written consent
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload or transmit viruses, malware, or any other malicious code
• Use the platform in any way that could damage, disable, overburden, or impair its operation
• Violate any applicable local, national, or international law or regulation

Your use of EquestrianOS is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection and use of your data as described in the Privacy Policy.

You retain ownership of all data you input into the platform, including student records, evaluation data, and lesson history ("Your Content"). You grant us a limited, non-exclusive licence to store, process, and display Your Content solely to provide the service to you.

You are responsible for ensuring that any personal data you enter about students, parents, or guardians is collected and processed in accordance with applicable data protection laws, including obtaining any necessary consents from the individuals concerned.

If you choose to connect your Google Calendar, you authorise EquestrianOS to create, update, and delete calendar events on your behalf using the Google Calendar API. This integration is entirely optional and can be revoked at any time from within the platform or from your Google Account settings.

Our use of Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements. We do not use Google Calendar data for advertising or any purpose other than providing the calendar sync feature.

EquestrianOS and all its content, features, and functionality — including but not limited to software, text, graphics, logos, and icons — are owned by Trail Barns and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the platform without our prior written consent.

Nothing in these Terms transfers any intellectual property rights to you. Your only right is to use the platform in accordance with these Terms.

EquestrianOS is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the platform.

EquestrianOS is a management tool and is not a substitute for professional judgement in matters of student safety, horse welfare, or equestrian instruction. Decisions about student readiness, horse suitability, and lesson content remain the sole responsibility of the barn operator and qualified instructors.

To the fullest extent permitted by applicable law, Trail Barns and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your use of or inability to use the platform
• Any unauthorised access to or alteration of your data
• Any conduct or content of any third party on the platform
• Any interruption or cessation of the service

Our total liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the amount you paid us in the twelve months preceding the claim, or £100 (whichever is greater).

You agree to indemnify, defend, and hold harmless Trail Barns and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your violation of any rights of another person or entity.

Either party may terminate the agreement formed by these Terms at any time. You may stop using the platform at any time. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law.

Upon termination, your right to use the platform ceases immediately. Sections 5 (Data and Privacy), 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 10 (Indemnification) shall survive termination.

You may request an export of your data within 30 days of termination by contacting us at [email protected].

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify barn owners by email or in-app notification. Your continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the platform.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by applicable consumer protection law in your jurisdiction.
